KPI Agency, Inc. (also referred to as “KPIA” or “we” or “us” or “our”) is a privacy-conscious company. This Privacy Policy describes what information we collect from users of www.theKPIagency.com and related websites and online services (referred to as “Website Services”) of KPI Agency and how we protect your information. By using the Website Services or continuing to receive Communications, you agree to the use of such information in accordance with this Privacy Policy.

Information collected

We may collect personal information when you interact with the Website Services, such as when you fill out a form, respond to a survey, request communications about a specific service of interest, or express interest in a job opening. Such information may include your name, email address, phone number, company name, and additional information you provide in an open field or via attachments.

We may also collect content that you provide, including postings and comments on blogs, forums, and resource areas of the Website Services.

By using our Website Services, you consent to the collection, use, and disclosure of information as described in this privacy policy.

Log information, cookies, and web beacons

The Website Services collect standard Internet log information, including your internet protocol (IP) address, browser type and language, access times, and referring website addresses. We may use your IP address and other non-personal information to help diagnose problems with our computer server and to provide a more optimal Website Services experience.

In order to provide the best experience, we may use cookies (small files stored in a user’s browser) to let us know that you are a prior user of the Website Services, what advertisement may have been clicked on to get to the website and to retrieve certain information previously provided by you. Information use

We may use the personal information you provide to us to manage our relationship with you, including your requests and expressed services of interest, or to customize or improve the Website Services and related services available to you. We may use your personal information to contact you by email, phone, or mail.

We may also use your personal information for marketing purposes, such as sending you electronic or printed communications or delivering digital advertisements to you. At any time, you may request that we discontinue sending you communications of any kind.

Disclosure of information to third parties

We will not give, sell, rent, loan, or otherwise disclose any of your personal information to any third party unless (1) you have specifically authorized us to do so; (2) we are legally required to do so, for example, in response to a governmental subpoena, court order, other legal process; and/or (3) it is necessary to do so in order to protect and defend our or a third party’s rights or property or to protect the safety of the public or any person.

The Website Services may use Social Media Applications that allow you to log in, comment, or share content with other users. Any information (personal or otherwise) that you initiate with the Social Media Application can be read, collected, and used by other users of that Social Media Application, over whom we have little or no control. Therefore, we are not responsible for any other user’s use, misuse, or misappropriation of any personal information or other information that you contribute to any Social Media Application.

California state residents are legally entitled to request information concerning whether their personal information has been disclosed to nonaffiliated third parties for direct marketing purposes. We do not share personal information with nonaffiliated third parties for such purposes.

Information security

Reasonable commercial standards of technology and operational security are in place to protect all personal information provided by users to us.

Any information you provide to KPI Agency through the Website Services may be stored and processed, transferred between, and accessed from the United States and other countries, which may not have the same level of protection of personal information as the one in which you reside. KPIA will handle your personal information in accordance with this Privacy Policy regardless of where your Personal Information is stored or accessed.

Children’s privacy protection

Our Services are not directed at or intended for use by minors. Therefore, we do not wish to receive, nor do we knowingly collect, personal information from minors via our Website Services. No one under age 13 may provide any personal information to us on or through our Website Services. In the event that we learn we have collected Personal Information from a child under age 13 without verification of parental consent, we will delete that information. Privacy Shield Frameworks

KPI Agency, Inc. complies with the EU-U.S. Privacy Shield Framework as set forth by the U.S. Department of Commerce regarding the collection, use, and retention of personal information from European Union member countries transferred to the United States pursuant to Privacy Shield. KPIA has certified that it adheres to the Privacy Shield Principles with respect to such data. If there is any conflict between the policies in this privacy policy and data subject rights under the Privacy Shield Principles, the Privacy Shield Principles shall govern. With respect to personal data received or transferred pursuant to the Privacy Shield Frameworks, KPIA is subject to the regulatory and enforcement powers of the U.S. Federal Trade Commission.

Pursuant to the Privacy Shield Frameworks, EU individuals have the right to obtain our confirmation of whether we maintain personal information relating to you in the United States. Upon request, we will provide you with access to the personal information that we hold about you. You may also correct, amend, or delete the personal information we hold about you. An individual who seeks access, or who seeks to correct, amend, or delete inaccurate data transferred to the United States under Privacy Shield, should direct their query to info@thekpiagency.com. If requested to remove data, we will respond within a reasonable timeframe.

We will provide an individual opt-out choice, or opt-in for sensitive data, before we share your data with third parties other than our agents, or before we use it for a purpose other than which it was originally collected or subsequently authorized. To request to limit the use and disclosure of your personal information, please submit a written request to info@thekpiagency.com.

In certain situations, we may be required to disclose personal data in response to lawful requests by public authorities, including to meet national security or law enforcement requirements.

KPI Agency’s accountability for personal data that it receives in the United States under the Privacy Shield and subsequently transfers to a third party is described in the Privacy Shield Principles. In particular, KPIA remains responsible and liable under the Privacy Shield Principles if third-party agents that it engages to process personal data on its behalf do so in a manner inconsistent with the Principles, unless KPIA proves that it is not responsible for the event giving rise to the damage.

In compliance with the Privacy Shield Principles, KPIA commits to resolve complaints about your privacy and our collection or use of your personal information transferred to the United States pursuant to Privacy Shield. European Union individuals with Privacy Shield inquiries or complaints should first contact us by email at info@thekpiagency.com.

KPIA has further committed to refer unresolved privacy complaints under the Privacy Shield Principles to an independent dispute resolution mechanism, the BBB EU PRIVACY SHIELD. If you do not receive timely acknowledgment of your complaint, or if your complaint is not satisfactorily addressed, please visit http://www.bbb.org/EU-privacy-shield/for-eu-consumers for more information and to file a complaint. This service is provided free of charge to you.

If your Privacy Shield complaint cannot be resolved through the above channels, under certain conditions, you may invoke binding arbitration for some residual claims not resolved by other redress mechanisms. Changes to this Privacy Policy

We may modify or amend this Privacy Policy from time to time at our discretion. Any changes made are effective immediately, and they will be reflected in the revision date at the top of this page.
